Notice of Financial Incentive - Spinelli Kilcollin In-Store Sweepstakes

This notice explains the financial incentive we offer in connection with the Spinelli Kilcollin In-Store Sweepstakes (the "Sweepstakes"), as required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), and its regulations. It applies to California residents. Capitalized terms not defined here have the meaning given in the Sweepstakes Official Rules at https://spinellikilcollin.com/pages/in-store-sweepstakes-us.

1. Summary of the Financial Incentive

We offer you the chance to enter the Sweepstakes and win a Spinelli Kilcollin gift card worth $1,000 US dollars (one prize per participating location in Los Angeles, Boston and New York) in exchange for providing the personal information listed in section 2 and joining our email marketing list. No purchase is necessary.

2. Material Terms

Personal information we collect. To enter, you provide the following, which fall within the CCPA category of identifiers:

• Full name
• Email address
• Phone number
• Mailing address
• Confirmation that you are 18 or older

How we use it. We use this information to administer the Sweepstakes, confirm eligibility, select and contact winners, deliver prizes, and comply with legal obligations. By entering, you also join our email marketing list, and we will use your email address to send you news, offers and updates. You can unsubscribe at any time (see section 4); unsubscribing will not affect an entry you have already made. We will use your phone number for marketing text messages only if you separately opt in; that opt-in is not required to enter or win.

Sharing. We share this information with service providers that help us run the Sweepstakes and our communications (such as HubSpot). We do not sell your personal information, and we do not share it for cross-context behavioral advertising, in connection with this Sweepstakes.

Retention. We keep Sweepstakes entry information for three (3) months after the Sweepstakes ends, and winner records for as long as required by law. Marketing contact information is kept until you unsubscribe or ask us to delete it.

Other terms. The Sweepstakes runs from October 23, 2026 to October 25, 2026 and is governed by the Official Rules, which set out eligibility, entry limits, odds and prize details.

3. How to Opt In

You opt in to this financial incentive by completing and submitting a Sweepstakes entry form in a participating store (on paper or by scanning the in-store QR code). By submitting the form, you confirm that you have read this notice, agree to take part in the financial incentive, and agree to join our email marketing list.

4. Your Right to Withdraw

You may withdraw from this financial incentive at any time, without charge, by emailing dear@spinellikilcollin.com with the subject line "Sweepstakes Withdrawal" or by writing to us at the address in section 6. If you withdraw before the drawing, your entry will be removed and you will no longer be eligible to win.

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any email, or by contacting us as above. Unsubscribing from marketing does not remove your Sweepstakes entry.

You also have other rights under the CCPA, including the rights to know, delete and correct your personal information and to opt out of its sale or sharing. 5. How the Incentive Relates to the Value of Your Data

We do not assign a specific monetary value to any individual consumer's personal information. In good faith, we estimate the value of the personal information collected through the Sweepstakes based on the expenses we incur to offer it, as permitted by the CCPA regulations.

Method: we divide the total cost of the Sweepstakes (the value of the prizes plus the cost of administering it) by the number of entries we expect to receive.

We believe the incentive is reasonably related to this estimated value because the expected value of the chance to win offered to each entrant is in line with what it costs us to collect and use each entrant's information, including their email address for marketing.
